Investing Direct acts as an introductory agent only. Our role is to introduce certified investors to innovative investment opportunities which allow them to earn steady and secure returns in the process.
A Loan Note is a professionally structured financial instrument; it is a legal contract that specifies the duration of the loan, when the loan is required to be re-paid and the interest payable.
The investment opportunities we introduce are not regulated by the FCA and therefore carry the requirement that the offering is only suitable for what is termed high net worth or sophisticated investor (applicable ONLY to UK based investors). This is a requirement of the Financial Services and Markets Act 2000.
All of the Loan Notes we introduce to investors offer a
legal charge security over the project at all times until their investment capital plus the agreed interest is repaid. In simple terms, the legal charge security means no other parties including the owners of the project can supersede the rights of the note holders, therefore the developer can’t sell or refinance until investors capital and interest has been repaid.
Loan Notes are becoming an increasingly common part of the smaller company finance landscape, taking over the role previously held by banks and investment houses who have benefitted from such high returns but simply haven’t passed them on to investors.
Under these circumstances, the Loan Notes would likely form part of your estate and the executors of your estate would hold title to the Loan Notes. Your executors would hold the Loan Notes until their redemption, or in such exceptional circumstances the issuer may redeem the Loan Note early.
